WISCONSIN — The Wisconsin Supreme Court on Wednesday struck down a 176-year-old abortion ban, ruling the 1849 law that was in place does not ban abortions.

In the 4-3 ruling, the court said it was superseded by a newer state law that criminalizes abortions only after a fetus can survive outside the womb.

The decision comes after Planned Parenthood of Wisconsin filed a lawsuit in February asking the court to rule on whether a constitutional right to abortion exists in the state.
